How to Get a Durable Power of Attorney

A durable power of attorney is a document that is used as a legal way to appoint some one to act on your behalf if you become incapacitated. To get one you can go down to your county’s courthouse and pay a ‘print fee’ for a copy for one. An even easier way to get one though is by going online and finding a durable POA form you can fill out at home on your PC then print out yourself; theirs many sites out there that offer these kind of fillable forms.

The Unintended Consequence Of Your Living Trust

Many couples have executed an A-B “credit shelter” trust in order to preserve estate tax exemptions for both spouses. This can potentially benefit the heirs by saving nearly one million dollars in inheritance taxes. The consequence of the credit shelter trust, however, is that estate assets are necessarily sheltered from the surviving spouse. Because language in many trusts calls for the credit shelter trust to be funded with an amount equal to the federal exclusion amount in effect at the time of death, the sheltered amount can be quite large and leave the surviving spouse with too little in the way of assets. Fortunately, proper estate planning, including the use of a “disclaimer A-B trust,” can relieve this problem.

Gagne With A Spoon

I didn’t “always want to be a lawyer”. I assume most doctors probably wanted to cure the sick from the time they were kids. Teachers surely had the desire to develop young minds from the time they were schoolchildren themselves. I think it is different for lawyers. Not many grew up with a burning desire to defend a corporation’s exclusive right to use a talking Chihuahua to sell Mexican fast food.

Motions To Modify Child Support In Rhode Island-modification Of Child Support By A Ri Family Lawyer

How is Child support modified in Rhode Island divorce and family law cases?

Child support in Rhode Island is not automatically modified when there is a change in circumstances. The parent must file a motion to modify child support. When a motion for modification of child support is filed a court date will be set by the clerk of the Rhode Island Family Court. In order to modify child support there must be a substantial change in circumstances. Under RI Law, a new child support amount does not run retroactive to when the circumstances actually changed! The new child support order should run retroactive to the date of the filing of the motion. Article by Attorney David Slepkow (401-437-1100)

Medical Malpractice - How To Become A Black Belt When Questioning A Doctor

Learn how to be a black belt attorney when questioning a doctor at their deposition.

1. Never give advance warning of what you intend to ask.

A black belt is confident of their abilities. They don’t need to show off. They don’t need to put on a show. They certainly don’t need to impress the doctor with their legal prowess. When questioning a doctor at a deposition, I always advocate asking the key questions in the case AT THE VERY BEGINNING of the questioning.
