Court Records

Court records can now be searched by the general public, but why would you need to? If you intend to employ a person and place them within a position of authority or trust, you would feel a lot better doing this with the knowledge that that person has not been to prison for a major crime. It is only recently that the general public has been able to access court records, not too long ago it was only the highest officials who had access to such sensitive information. Your only option was to either strain your way through all of the red tape (which could take months), become a court official or get arrested.

Beating Speeding Tickets And Higher Insurance Costs

The real cost of a speeding ticket goes far beyond the actual fine. Different car insurance companies have different premium penalties for speeding. But to put this in perspective, let’s take Prudential in California, just as an example.

A single speeding ticket would up the insurance cost with a surcharge of approximately 27%. So if someone were paying $750 a year, they would now be paying $952. That’s $202 extra dollars in addition to the cost of the ticket.

Lessons Learned - Register Your Copyright Before You Go To Court

Copyrights are created at the click of the shutter. But to enforce your rights in court for infringement claims, you must first register your copyright before you bring suit in federal court. Period. It doesn’t matter when the infringement is committed or the registration is completed, you still must register before filing suit.

It’s too bad that a freelance writer, Glynn Wilson, in Alabama didn’t learn this lesson earlier. He recently sued Kitty Kelley alleging that she used without permission some of his material for her best-selling book about the Bush family, “The Family: The Real Story of the Bush Dynasty.” The validity of his claim will never be decided in court. He had to withdraw his copyright infringement suit after realizing that he was likely to lose because he had failed to register his copyright with the United States Copyright Office. http://www.nytimes.com/2005/03/19/arts/19kell.html

Pondering The Photo Contracts Of The Future, When A Buyer Wants Re-use Of Your Photo

Since as photographers, we have always licensed (rented) our photos, it is shocking to us to find a photobuyer assuming that their payment for a photo represents both present and future use of the photo.

Unless a “work-for-hire” agreement is arranged in writing between the photobuyer and the stock photographer, payment for the use of a photo is for one-time rights only.

The Benefits Of Settling A Case Prior To Trial

You will notice on our firm website that many of our cases are settled out of court, rather than trying the case in court with a jury. This is not a cop out by any means and settling a case is almost always more beneficial to the client than taking the case before a jury.

Justice For Mr. Reid-the Shoe Bomber

A Contract To Enter Into A Contract Is Unenforceable

Real Estate, by its own very nature, is all black and white - you either do things, or you don’t.

There is no grey area in Real Estate, which one can find otherwise in commerce and trade. For instance, letter of intents that are widely used prior and during negotiations between corporations or between individuals and corporations have no place whatsoever in the world of real estate, where the only subject matter of trade is the exchange of titled interests in land for money. One cannot stipulate today to contract out in the future and hope the stipulation will be upheld, unless such an agreement is contained in a contract drafted and accepted today and is in the form of an option.

Bork-peril Justice

On June 6, 2007, Robert H. Bork caused to be filed a lawsuit in the Federal Court for the Southern District of New York, wherein he is the named Plaintiff, and the Yale Club of New York City is the named Defendant.

Mr. Bork’s cause of action arises out of an incident which occurred on June 6, 2006, on which date Mr. Bork was visiting the Yale Club, a private club, in New York City, to deliver a speech at a luncheon sponsored by the New Criterion Magazine. It is perhaps interesting to note that Mr. Bork, though not a Yale alum, was a professor at the Yale School of Law during the Sixties and Seventies. He is currently a Professor of Law at the Ave Maria Law School located in Ann Arbor, Michigan. It does not appear that he was on medical leave during the 2006-2007 academic year.
