RESOLVING SPECIFIC PROBLEMS

I received a copy of my credit report and saw about a half dozen items that I didn’t know anything about. It’s affected my credit rating so badly that I couldn’t get a student loan. I didn’t realize there was a problem until my student loan application was denied.

While dealing with problems resulting from identity theft can be time consuming and frustrating, most victims can resolve their cases by being assertive, organized, and knowledgeable about their legal rights. Some laws require you to notify companies within specific time periods. Don’t delay in contacting any companies to deal with these problems, and ask for supervisors if you need more help than you’re getting.

Identity theft is a horrible crime and it occurs more often than you know. But the real tragedy is that no one cares. The credit card companies, the stores and the collection people could care less. All they want is the money and they don’t care where it comes from. As a matter of fact they hope you will pay it because if you prove that it was a theft they get nothing.

So, the collector’s will pressure you to pay to save your credit rating or protect your good name. If that doesn’t work they will accuse you of filing a false report to avoid paying for all the stuff you bought. They have one goal and that is to collect the money.

Question: ? Is it true that the state gets everything if I die without a Will??

Concerned clients routinely ask this question expressing their concern in keeping the State from taking their hard-earned estate upon their deaths. Fortunately, the State does not take the property of someone dying without a Will. Instead, Texas law dictates how the assets of someone dying without a Will are divided upon their death.

There are a variety of methods that thieves use to steal identity details:

- Physical theft, especially of your purse or wallet, or of your mail, is a common means of identity theft. A break-in to your home or a “stair dancer” intruding into your office workplace, are other opportunities. Going through your trash can for identity information is another.

- A variation on stealing your mail that some thieves use, is simply to divert it. They can do this by arranging with the post office for your mail to be redirected, or by simply writing to banks, credit card companies or other financial institutions, and telling them that you have moved.

Though the act was amended several times, the most important amendment came about in the year 1952, when congress passed a new patent act codified under Title 35 of the United States Code. Though a few changes were made in 1986, 1996 and 1999, most provisions of the 1952 Act are still in effect.

No longer can small garage inventors afford to get a patent for something they built in their garage that the world really needs. Instead the idea is stolen and some larger company simply starts mass-producing it as fast as possible and applies and gets the patents using in-house attorneys. The garage inventor is screwed as the costs for private attorneys to file these patents and the bureaucracy and time to move through the process is often unworkable. It is a typical government mess.
